1. Scope

These Terms and Conditions (T&C) apply to all contracts concluded via the Offbeat Spots online shop between Offbeat Spots (hereinafter "Provider") and customers (hereinafter "Customer"). By purchasing a digital product, the Customer agrees to these T&C.

2. Subject of the Contract

The Provider sells digital products in the form of Google Maps lists featuring unique locations, as well as a PDF document that helps the Customer make the most of these lists. Access to the lists is provided via an individual link after purchase.

3. Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to place an order.

(2) By completing the order process, the Customer submits a binding purchase offer.

(3) The contract is concluded only when the Provider confirms the purchase via email.

 

4. Prices and Payment Terms

(1) All prices include statutory value-added tax (VAT).

(2) Payment is made via the payment methods offered during the order process.

(3) Access to the digital products is granted after successful payment.

 

5. Delivery and Use of Digital Content

(1) After completing the purchase, the Customer will receive access to the purchased digital products via email.

(2) The use of the Google My Maps Lists is restricted to the Customer's personal use. Redistribution or reproduction is prohibited.

(3) The Provider reserves the right to make changes or updates to the lists.

 

6. Right of Withdrawal

According to § 356 (5) of the German Civil Code (BGB), the right of withdrawal for digital products expires once the Customer has expressly agreed that the execution of the contract begins before the withdrawal period ends and has confirmed their awareness that this results in the loss of the right of withdrawal.

 

7. Warranty and Liability

(1) The Provider does not guarantee the permanent availability of the Google My Maps Lists, as external platforms are involved.

(2) Liability for incorrect or outdated information in the lists is excluded.

(3) The Provider is only liable for damages caused by gross negligence or intent.

 

8. Privacy Policy

8.2 Collected Data

The following data is collected during the ordering process:

• Name

• Email address

• Address

• Payment information

These data are required to fulfill the contract and will not be shared with third parties, except for payment service providers for payment processing.

 

8.3 Data Retention Period

Data is stored only as long as necessary for contract fulfillment. Tax-relevant data will be stored in accordance with statutory retention obligations.

 

8.4 Customer Rights

The Customer has the right to:

• Request information about stored data

• Correct incorrect data

• Request deletion of data, provided no legal obligations prevent it

Requests can be sent to the Provider via email.

9. Final Provisions

(1) The laws of the Federal Republic of Germany apply.

(2) If any provision of these T&C is found to be invalid, the remaining provisions remain unaffected.

(3) The place of jurisdiction for all disputes is the Provider's registered office.
